Obtaining of Georgian Citizenship by Persons Residing in the Territory of Georgia before March 31, 1993

How to prove Georgian citizenship and obtain identity documents of a citizen of Georgia − consider another case of Just Advisors migration practice.

The company was approached by a Client who currently lives in Ukraine, who does not have any documents confirming his citizenship and identity.

What the law says: Georgian citizenship is recognized for persons born before March 31, 1993, if:

1). the person was born before March 31, 1975 and by March 31, 1993 had lived in the territory of Georgia for at least five years and did not receive citizenship of another country;

2) the person was born after March 31, 1975 and by March 31, 1993 lived in the territory of Georgia and did not receive citizenship of another country;

3). the person was born on the territory of Georgia, left the country after December 21, 1991 and did not receive citizenship of another country.

With an application for obtaining Georgian citizenship, you can apply to the territorial services of the House of Justice or the Agency for the Development of National Services online, or to diplomatic missions or consular departments abroad.

Our Client was born in Georgia before 1993 and lived in Georgia until 1995. He was not a citizen of another country.

To obtain a Georgian passport, we had to confirm both of these circumstances. And on the issue of residence in Georgia, difficulties appear, since there were no documents confirming the fact of residence. Based on the Client’s memories of his place of residence and social circle, we found the Client’s neighbors who agreed to testify to the fact of their residence. The notarized testimonies of 4 neighbors-witnesses were presented to a special commission of the municipality where our Client lived, as evidence of the fact of the Client’s residence in Georgia during the period established by law.

The City Hall Commission, based on the evidence presented, in accordance with Art. 30 2 clause 2 of the Law of Georgia «About Citizenship of Georgia» issued the necessary certificate, on the basis of which the Agency made a decision on the establishment of citizenship.
